As everyone should be aware, legislation regarding the regulation of home inspectors has proceed into the proverbial backstretch at this time.
 
Some major changes were proposed today for HB 161, if approved by vote it will proceed as HB 161C3 for future reference.

Florida Legislation Update - HB 153

As previously reported, while the Florida Legislature does not convene until March 7th, legislation regarding home inspections was been pre-filed. HB 153 would enact regulations regarding home inspection services, requirements, exemptions, prohibited acts, insurance, limitations and enforcement.

HB 153 outlines the following as requirements for practices:
• Complete at least 80 hours of home inspection courses, including passing scores of valid home inspection examinations
• Annually complete 8 hours of continuing home inspection education
• Have a commercial general liability insurance policy for at least $300,000

HB 153 states that in order for a business to provide home inspection service each home inspector of the business must satisfy all the requirements of the bill. The bill also specifies occupations that are exempt from these regulations. The bill outlines prohibited acts and specifies the disciplinary actions for violating the provisions of HB 153

HB 153 was pre-filed by Representative Allen and referred to the Business Regulation Committee. While the legislative session does not begin until March 7th, committees may hold pubic meetings on legislation.

On January 10, the Department of Business and Professional Regulation (DBPR) presented an update to the Business Regulation Committee on mold and home inspection legislation. The DBPR recently sent the Governor the findings from the series of meetings the DBPR held this past summer in response to the Governor’s veto of mold and home inspection legislation last year. The Governor’s Office characterized the DBPR findings as insufficient in addressing his concerns. At the hearing, the DBPR updated the Business Regulation Committee and promised to submit a report on their findings in two weeks.

On January 11, Representative Allen withdrew HB 153 prior to introduction. According to Business Regulation Committee staff, HB 153 cannot be “un-withdrawn” and can be considered “dead.”

Following the withdrawing of HB 153, another bill may need to be tracked. HB 161, dealing with mold remediation and assessment, was pre-filed and referred to the Business Regulation Committeel.
Representative Domino, the author of HB 315 last year (the mold and home inspection legislation that was vetoed), is the author of HB 161. Business Regulation Committee staff suggested that HB 153 may have been withdrawn so the home inspection provisions could be incorporated into HB 161. This could happen when the DBPR releases its report in two weeks.
